Tutoring Services Agreement

This Tutoring Services Agreement (the "Agreement") is made between [Tutor (your name or business)] ("Tutor"), whose qualifications are: [Tutor qualifications], and [Client full name (parent, or the student if an adult)] ("Client") for the tutoring of [Student name] (the "Student"), currently in [Student grade or level]. Where Client is the Student, references to Client and Student are to the same person. Tutor and Client are each a "Party" and together the "Parties".

1. Services

Tutor shall provide individual instruction to the Student in [Subject(s)] (the "Services"). The goals of the tutoring, and any learning needs Client has disclosed, are: [Goals and any learning needs]. Tutor shall assess the Student’s current level at the outset, prepare each session, teach in a manner suited to the Student, assign practice where appropriate, and adjust the approach as the Student progresses. Tutor may use Tutor’s own materials and reasonably priced published materials, which Client shall purchase or reimburse when Tutor requests in advance.

2. Schedule and Location

Sessions take place [Schedule], each lasting [Session length (minutes)] minutes, beginning on [First session], at the following location: [Location]. Either Party may propose a change to the regular schedule on at least one (1) week’s notice, and sessions during school holidays shall be agreed in advance. For online sessions, Client shall provide the Student with a reliable connection, a camera and a quiet space; for sessions at Client’s home, a quiet, well-lit place to work with a parent or other responsible adult present in the home when the Student is a minor.

3. Fees and Payment

Client shall pay Tutor [Hourly rate] per hour, pro rata for the session length, for each session attended or chargeable under Section 4. Payment terms: [Payment]. Where sessions are prepaid in blocks, unused sessions remain available for six (6) months from purchase and are refundable at the per-session rate if Client terminates under Section 10. Amounts unpaid more than fourteen (14) days after they are due accrue interest at one percent (1%) per month or the highest rate permitted by law, whichever is less, and Tutor may suspend sessions until the account is current.

Tutor may change the hourly rate on thirty (30) days’ written notice, and not more than once in any twelve (12) months. Travel to a location more than ten (10) miles from Tutor’s base, if Client requests it, is charged at half the hourly rate for travel time unless the Parties agree otherwise in writing.

4. Cancellation, Lateness and No-Shows

Client may cancel or reschedule a session without charge on at least [Cancellation notice (hours)] hours’ notice by text message, email or phone. A session cancelled on shorter notice, or a session the Student does not attend, is charged at the full rate, except that Tutor shall waive the charge once per calendar month for the Student’s documented illness. If the Student arrives late, the session ends at the scheduled time and is charged in full. If Tutor cancels a session on shorter notice than the Client is required to give, Tutor shall offer a make-up session within seven (7) days at no additional charge.

If the Student is more than fifteen (15) minutes late for an in-person session without notice, Tutor may leave, and the session is chargeable. Tutor shall wait fifteen (15) minutes for an online session before treating it as a no-show.

5. Progress Reports

Tutor shall report the Student’s progress to Client as follows: [Progress reports]. Reports shall describe the material covered, the Student’s strengths and areas needing work, practice assigned, and recommendations. Tutor shall tell Client promptly of any concern about the Student’s attendance, effort or wellbeing. Client may ask Tutor to communicate with the Student’s teacher or school, and Tutor shall do so with Client’s written authorisation, at the hourly rate for time beyond fifteen (15) minutes per month.

6. Responsibilities of Client and Student

Client shall ensure the Student attends sessions prepared, with textbooks, assignments, past tests and any teacher feedback; shall tell Tutor of the school curriculum, upcoming tests and deadlines; shall inform Tutor of any learning difference, accommodation, health condition or circumstance that affects the Student’s learning; and shall encourage the Student to complete practice Tutor assigns. Client acknowledges that progress depends substantially on the Student’s effort and attendance.

7. Academic Honesty

Tutor shall teach the Student to understand and complete their own work. Tutor shall not complete graded assignments, write or substantially rewrite essays or projects for submission, provide answers to take-home assessments, or assist the Student during any examination, and Client shall not ask Tutor to do so. Tutor may help the Student plan, practise, revise and check their own work. Tutor shall comply with the academic integrity rules of the Student’s school or testing organisation to the extent Client makes them known.

8. Confidentiality and Safeguarding

Tutor shall keep confidential all information about the Student and Client, including grades, assessments, learning needs and family circumstances, and shall not disclose it except to Client, with Client’s consent, or as required by law, including any duty to report suspected abuse or neglect. Tutor shall not use the Student’s name or work in advertising without Client’s written consent.

Where the Student is a minor, Tutor shall communicate with the Student only about tutoring and shall copy Client on written communications; shall not be alone with the Student behind a closed door in a private residence; shall not transport the Student; and shall not photograph or record the Student except for online sessions recorded with Client’s consent. Tutor represents that Tutor has disclosed to Client any criminal conviction or finding relevant to working with children and consents to a background check at Client’s expense.

9. No Guarantee of Results

Tutor shall provide the Services with reasonable skill and care but does not guarantee any particular grade, test score, admission, qualification or other outcome. Academic results depend on the Student’s ability, effort, attendance, school instruction, health and other factors outside Tutor’s control. Client acknowledges that no representation about results has been made, and Tutor’s liability under this Agreement shall not exceed the fees paid in the preceding three (3) months.

10. Term and Termination

This Agreement begins on the date of the first session and continues until either Party terminates it on fourteen (14) days’ written notice for any reason. Either Party may terminate immediately by written notice if the other materially breaches this Agreement, including non-payment, a request to breach Section 7, or conduct that makes continued tutoring inappropriate. On termination Client shall pay for all sessions attended or chargeable, and Tutor shall refund any prepaid sessions not used and shall return the Student’s materials.

11. General

This Agreement is governed by the laws of the State of [Governing law (state)]. It is the entire agreement between the Parties about the Services and supersedes all prior discussions. It may be amended only in a writing signed by both Parties, which may be by email. If any provision is held unenforceable, the rest remains in effect. Tutor is an independent contractor, may teach other students, and is responsible for Tutor’s own taxes and insurance. Neither Party is liable to the other for indirect or consequential damages.

This Agreement may be signed electronically and in counterparts, and the electronic execution record, timestamps and document fingerprints kept by the signing platform are conclusive evidence of its execution.

Tutoring Agreement FAQ

Can a tutor guarantee a grade or a test score?

No honest tutor can, and the agreement says so. Results depend on the student’s effort, attendance, school instruction and many other factors outside the tutor’s control. What the tutor does promise is qualified, prepared, individualised instruction and honest reporting of progress. A tutor who advertises guaranteed scores is either refunding a lot of money or not telling the truth.

What is a reasonable cancellation policy for tutoring?

Twenty-four hours is standard. A session cancelled inside the window or missed without notice is charged at the full rate because the tutor reserved the time; the agreement waives this for a documented illness once per month. The tutor is held to the same standard and makes up any session they cancel late at no charge.

Will the tutor do my child’s homework?

No. The agreement states that the tutor teaches the student to do the work and does not complete graded assignments, write essays for submission, or help during an exam. That protects the student from an academic integrity finding and protects the tutor’s reputation. Practice problems and unassigned exercises are fine.

Can I leave the student’s details blank for the parent to fill in?

Yes. Any blank you leave becomes a fill-in field for the parent or student when they open the link, and you see what they entered before you sign. Tutors usually fill in the subject, schedule, rate and policies and leave the student’s name, grade, goals and any learning needs for the parent, who knows them.

How often should a tutor report progress?

For a school-age student, a short written note after each session and a fuller report monthly is typical; for test prep, a report after each practice test. The agreement lets you pick the frequency. Reports cover what was worked on, what the student is doing well, what needs work, and what to do before the next session.

What safeguards apply when tutoring a child?

The agreement requires that a parent or another adult be present in the home or that sessions take place in a public or supervised setting or online, that the tutor not communicate with a minor student except about tutoring and with the parent copied, and that the tutor disclose any relevant criminal history. Parents should still ask for references and a background check.
