Personal Training Agreement and Release

This Personal Training Agreement and Release (the "Agreement") is made between [Trainer (your name or business)] ("Trainer"), holding the following certifications: [Certification(s)], and [Client full name] ("Client"), born [Client date of birth]. Trainer and Client are each a "Party" and together the "Parties". READ SECTIONS 5 AND 6 CAREFULLY: THEY AFFECT YOUR LEGAL RIGHTS.

1. Training Package

Trainer shall provide Client with a package of [Number of sessions in the package] personal training sessions of [Session length (minutes)] minutes each (the "Package"), at [Where sessions take place]. Client’s stated goals are: [Client’s goals]. Each session includes an individualised programme of exercise designed by Trainer, instruction in technique, supervision and progress tracking. Trainer shall design the programme with reasonable care based on the information Client provides and shall adjust it as Client progresses. Sessions may be delivered online by video where the Parties agree; Client is responsible for a safe space and suitable equipment for online sessions.

2. Price, Payment and Expiry

Client shall pay Trainer [Package price] for the Package (the "Price"). Payment: [Payment]. Sessions are not provided while any instalment is overdue. The Price excludes gym membership or day-pass fees, which Client pays directly to the facility, and any equipment Client purchases.

Sessions in the Package expire [Sessions expire (days after purchase)] days after the date of purchase, and unused sessions after that date are forfeited without refund, except as Section 8 provides. Sessions are personal to Client and may not be transferred or shared with another person without Trainer’s written consent.

3. Scheduling and Cancellation

Sessions are scheduled by agreement, in writing or through Trainer’s booking system. Client may cancel or reschedule a session without charge on at least [Cancellation notice (hours)] hours’ notice. A session cancelled on shorter notice, or a session Client does not attend, is counted as used and deducted from the Package, except where the late cancellation is due to a documented medical emergency. If Client arrives late, the session ends at the scheduled time.

Trainer shall give Client the same notice of any session Trainer must cancel. A session Trainer cancels on shorter notice is not deducted and is rescheduled at Client’s convenience, and if Trainer is more than fifteen (15) minutes late, Client receives the missed time in a later session.

4. Health Disclosure and Physician Clearance

Client discloses the following medical conditions, injuries, medications and physician restrictions: [Medical conditions, injuries, medications or physician restrictions (or "None")]. Physician clearance screening: [Health conditions your trainer should know (heart, blood pressure, joints)]. Emergency contact: [Emergency contact: name and phone].

If Client has answered yes to any screening question, Client shall obtain written clearance from a physician before the first session and Trainer may decline to train Client until it is received. Client represents that the information given is complete and accurate, shall inform Trainer before each session of any change in Client’s health, injury, pregnancy or medication, and shall stop exercising and tell Trainer immediately of any pain, dizziness, shortness of breath or discomfort during a session. Trainer relies on this information and is not responsible for injury arising from information Client did not disclose.

5. Assumption of Risk

Client understands that exercise, including resistance training, cardiovascular exercise, stretching, and the use of weights, machines and other equipment, involves inherent risks that cannot be eliminated regardless of the care taken. These risks include muscle, tendon, ligament and joint strains, sprains and tears; fractures; heart attack, stroke and other cardiovascular events; dizziness, fainting and exhaustion; aggravation of existing conditions; and, in rare cases, permanent disability or death. Client voluntarily chooses to take part with full knowledge of these risks and assumes all of them, whether arising from the exercise itself, the equipment, the premises, the conduct of others, or the ordinary negligence of Trainer.

6. Release and Waiver

To the fullest extent permitted by law, Client, for Client and Client’s heirs and personal representatives, RELEASES AND DISCHARGES Trainer and Trainer’s employees, contractors and assistants from any claim or liability for injury, illness, death or property loss arising out of Client’s participation in training, INCLUDING CLAIMS ARISING FROM THE ORDINARY NEGLIGENCE OF TRAINER, and covenants not to sue on any such claim. This release does not extend to gross negligence, reckless or intentional misconduct, or any liability that cannot be released under applicable law. Client shall indemnify Trainer against claims by third parties arising from Client’s conduct.

CLIENT SHALL INITIAL THIS SECTION TO CONFIRM THAT CLIENT HAS READ AND UNDERSTANDS SECTIONS 5 AND 6.

7. No Guarantee; Scope of Advice

Results depend on Client’s effort, consistency, nutrition, sleep, genetics and health, and Trainer does not guarantee any particular result, including weight loss, strength gains or athletic performance. Trainer is not a physician, physical therapist or dietitian and does not diagnose or treat any condition or provide medical advice. Any general guidance about nutrition or recovery is educational only, and Client should consult a physician or registered dietitian for individualised advice. Nothing Trainer says replaces the advice of Client’s physician.

8. Refunds, Pauses and Termination

The Price is non-refundable except that, if Client becomes unable to continue because of an injury or medical condition documented by a physician, or relocates more than fifty (50) miles from the training location, Client may terminate and receive a refund of the unused sessions at the per-session rate, less any discount that applied to the Package. Client may pause the Package once, for up to sixty (60) days, for documented illness, injury, pregnancy or travel of two (2) weeks or more, and the expiry date extends by the length of the pause.

Trainer may terminate this Agreement and refund unused sessions if Client repeatedly fails to follow safety instructions, attends under the influence of alcohol or drugs, is abusive, or if Trainer becomes unable to continue, in which case Trainer may instead offer a qualified substitute trainer whom Client may accept or decline.

9. Trainer’s Responsibilities and Conduct

Trainer represents that Trainer holds the certifications stated above and current CPR and AED certification, carries professional liability insurance, and shall provide a certificate on request. Trainer shall supervise sessions, instruct proper technique, select loads appropriate to Client’s ability and stated health, maintain Client’s information in confidence, and observe the rules of any facility where sessions take place. Trainer may take progress photographs and measurements only with Client’s consent and shall not publish them without separate written permission.

10. General

This Agreement is governed by the laws of the State of [Governing law (state)]. It is the entire agreement between the Parties about the Package and supersedes all prior discussions. It may be amended only in a writing signed by both Parties, which may be by email. If any provision is held unenforceable, the rest remains in effect and the provision shall be modified to the minimum extent needed to make it enforceable. Trainer is an independent contractor. Neither Party is liable to the other for indirect or consequential damages.

Client has read this Agreement, understands that Client is giving up substantial rights in Sections 5 and 6, and signs voluntarily. This Agreement may be signed electronically, and the electronic execution record, timestamps and document fingerprints kept by the signing platform are conclusive evidence of its execution.

Personal Training Agreement FAQ

Do unused sessions expire?

Under this agreement, yes, after the number of days you set from the date of purchase, which is typically 90 to 180 days for a 10- to 20-session package. Expiry keeps clients consistent and lets the trainer plan. The agreement allows a pause for documented injury, illness, pregnancy or travel of two weeks or more, so a client is not penalised for a genuine interruption.

What is a fair cancellation policy for personal training?

Twenty-four hours is the industry standard; some trainers use twelve for online sessions. A session cancelled inside the window, or a no-show, is deducted from the package because the trainer has reserved the hour. A client who arrives late gets the remainder of the scheduled time. The agreement holds the trainer to the same standard: a session the trainer cancels late is made up free.

Is the release enforceable if I get hurt?

For the inherent risks of exercise and the trainer’s ordinary negligence, in most states yes, provided the client read and initialed it, which is why it is separate and initialed. No release covers gross negligence, such as loading a bar far beyond a client’s stated capacity or ignoring symptoms of a heart attack. A few states, including Louisiana, Montana and Virginia, do not enforce pre-injury releases of negligence at all; there, the assumption-of-risk language still helps and insurance does the rest.

Can I leave the health questions blank for the client?

Yes, and you should. Any blank you leave becomes a fill-in field for the client when they open the link, and you see what they entered before you sign. Trainers fill in the package, price and policies and leave the health disclosure, emergency contact and physician clearance for the client, who is the only person who can answer them.

Do I need a doctor’s clearance before training?

The agreement asks the client to confirm whether they have been advised by a physician not to exercise and whether they have any condition on the standard screening list, such as heart disease, chest pain, dizziness, high blood pressure, joint problems or pregnancy. If they answer yes to any, the trainer may require written clearance before the first session. That is the accepted pre-participation screening standard and protects both sides.

Can the trainer give me a diet plan?

General healthy-eating guidance, yes. An individualised meal plan or advice to treat a medical condition may be the practice of dietetics, which requires a licence in many states, and the agreement says the trainer does not provide it. If you want a nutrition programme, a registered dietitian can work alongside the trainer.
