Landscaping and Lawn Care Service Agreement
This Landscaping and Lawn Care Service Agreement (the "Agreement") is made between [Your business name] (the "Landscaper") and [Client name or company] (the "Client") for work at [Property address] (the "Property"). The Landscaper and the Client are each a "Party" and together the "Parties".
1. Services
The Landscaper shall provide the following kind of service at the Property: [Kind of service]. Each visit includes the following (the "Services"): [Services included].
The following extras are available at an added charge and are done only when the Client asks for them first: [Extras at an added charge (or "None")]. The Landscaper may decline work that is unsafe, that needs a licence it does not hold, or that is near overhead power lines.
2. Schedule and Weather
Visits take place [How often], starting on [First visit or start date], during [Season (for recurring service)], on a day the Parties agree, which may be confirmed by text or email. The Landscaper may move a visit to the next workable day because of rain, drought restrictions, snow, frozen or waterlogged ground, or other conditions in which the work would damage the lawn or be unsafe, and shall let the Client know. Where the Price is charged per visit, a visit that is skipped and not made up is not charged. Where the Price is charged per month, it already allows for a normal number of weather days and does not change because of them.
3. Price and Payment
The Client shall pay [Price] [The price is charged] (the "Price"), plus the stated charge for any extras the Client asked for and sales tax where the law requires it. Payment: [Payment].
Amounts not paid within fifteen (15) days after they are due accrue interest at one percent (1%) per month or the highest rate the law allows, whichever is less, and the Landscaper may pause visits while an amount is overdue. The Landscaper may change the Price for a new season, or on thirty (30) days’ written notice, and the Client may end this Agreement under Section 8 instead of accepting the change.
4. Treatments
Fertilizer, weed and pest treatments: [Fertilizer, weed or pest treatments]. Any treatment shall be applied only by a person allowed by law to apply it, at the rates on the product label, and in line with local rules on timing and runoff. The Landscaper shall tell the Client before each treatment, and leave a notice where the law requires one, so that people and pets can keep off the treated area for as long as the label says. The Client shall tell the Landscaper about any plants, wells, ponds or vegetable gardens that need to be avoided.
5. Access and the Property
The Client shall give the Landscaper access to the areas to be worked on at the scheduled times, keep gates unlocked or provide codes, and keep pets secured during visits. Access notes from the Client: [Gate codes, pets, sprinklers or hidden lines (or "None")]. The Client shall mark or tell the Landscaper about sprinkler heads, irrigation lines, invisible pet fences, low-voltage lighting, septic parts and anything else hidden in the lawn or beds, and shall clear toys, hoses and debris from the lawn before visits. Before any digging, the Landscaper shall request a utility locate where the law requires one.
6. Damage
The Landscaper shall take reasonable care of the Property and is responsible for damage caused by its own negligence or that of its crew, provided the Client reports it in writing within seventy-two (72) hours after the visit. The Landscaper is not responsible for damage to things that were hidden and not marked or pointed out, for stones or objects thrown from a lawn the Client did not clear, for plants that fail because of drought, disease, pests or the Client not watering them, or for the condition of trees and structures it was not engaged to look after.
7. Plants and Materials
Plants, mulch and other materials the Landscaper supplies are charged at the prices agreed in advance. The Landscaper shall replace, once and at no charge, any shrub or perennial it installs that dies within thirty (30) days of planting, provided the Client watered it as the Landscaper instructed in writing. Annuals, seed, sod that is not watered, and plants damaged by weather, animals or others are not covered.
8. Term and Ending the Agreement
This Agreement starts on the date of the first visit. A recurring service continues from season to season until either Party ends it by giving at least [Notice to end the agreement (days)] days’ written notice, which may be by email. A one-time job ends when it is finished and paid for. Either Party may end this Agreement straight away by written notice if the other seriously breaks it, including by not paying, by making the Property unsafe to work on, or by abusive conduct. On ending, the Client shall pay for visits and work done up to the end date.
9. General
This Agreement is governed by the laws of the State of [Governing law (state)]. It is the whole agreement about the Services and replaces earlier quotes and discussions about them. A change must be in writing, which may be by email from both Parties. If any part cannot be enforced, the rest still applies. The Landscaper is an independent business, controls how the work is done, and is responsible for its own crew, equipment, taxes and insurance. Neither Party is liable to the other for indirect or consequential losses.
This Agreement may be signed electronically and in counterparts, and the electronic execution record, timestamps and document fingerprints kept by the signing platform are evidence of its execution. Each person signing confirms they may sign for the Party they sign for.
