Remote Work Agreement

This Remote Work Agreement (the "Agreement") is made between [Employer legal name] (the "Company") and [Employee full legal name] (the "Employee"), who is employed by the Company as [Job title], reporting to [Manager (name and title)]. The Company approves the Employee working remotely on the terms below, beginning on [Arrangement begins]. This Agreement supplements, and does not replace, the Employee’s existing terms of employment and the Company’s policies. The Company and the Employee are each a "Party".

1. The Arrangement

The arrangement is: [Type of arrangement]. Required on-site days: [Required on-site days (or "None")]. Remote work is a privilege the Company extends on a case-by-case basis and is not an entitlement, a term of employment or a benefit. The Employee’s pay, benefits, classification, duties, performance expectations and at-will status are unchanged by this Agreement. The Employee remains subject to every Company policy, including those on conduct, anti-harassment, equal employment opportunity, information security and acceptable use, as if working on the Company’s premises.

2. Work Location

The Employee’s approved remote work location is [Approved remote work address] (the "Remote Location"). The Employee shall perform remote work from the Remote Location and shall not work from any other location on a regular basis, and shall not relocate the Remote Location, move to another state or country, or work from another state or country for more than ten (10) working days in any calendar year, without the Company’s prior written approval. The Employee acknowledges that the work location affects payroll tax, workers’ compensation, unemployment insurance and the employment laws that apply, and that the Company may decline a request to relocate for those reasons. The Company will not reimburse commuting expenses between the Remote Location and any Company office.

3. Hours and Availability

The Employee shall be available and working during core hours of [Core hours the employee must be available] [Time zone for core hours] on each remote working day, shall respond to calls, messages and email from colleagues and customers within the time the Company expects of on-site employees, shall keep their calendar and status accurate, and shall attend meetings by video with camera on unless the manager agrees otherwise. The Employee shall arrange dependant care so that it does not interfere with working time.

The position is classified as [FLSA classification]. If non-exempt, the Employee shall accurately record all time worked using the Company’s timekeeping system, shall take meal and rest breaks as required by the law of the state where the Employee works, shall not work outside scheduled hours or perform overtime without the manager’s advance approval (though all time actually worked will be paid), and shall not perform work while off the clock. If exempt, the Employee shall work the hours reasonably needed to perform the position.

4. Equipment

The Company provides the following equipment for the Employee’s use in performing remote work: [Equipment the Company provides] (the "Company Equipment"). The Company Equipment remains Company property, shall be used only by the Employee and only for Company business, shall be kept in good condition, and shall be returned within five (5) business days after the arrangement or the employment ends, or earlier on request, with the Company providing prepaid shipping. The Employee shall report loss, theft or damage immediately. The Employee provides the following at the Employee’s own expense: [What the employee provides]. The Company is not responsible for the Employee’s personal equipment or for any damage to it, except as expense reimbursement below provides.

5. Expenses

The Company shall pay the Employee a remote-work stipend of [Monthly remote-work stipend (or $0)] per month, intended to cover the business portion of the Employee’s internet, phone and utility costs, paid through payroll and subject to applicable tax rules; if the amount is zero, no stipend is paid. In addition, the Company shall reimburse: [Other reimbursable expenses (or "None")]. Other expenses are reimbursable only if approved in advance by the manager and submitted with receipts under the Company’s expense policy. Nothing in this Section reduces any reimbursement required by the law of the state where the Employee works.

6. Information Security and Confidentiality

The Employee shall: (a) access Company systems and data only through Company Equipment or devices the Company has approved, and only through the Company’s VPN or other approved secure connection; (b) not store Company data on personal devices, personal email or personal cloud accounts; (c) keep Company Equipment locked when unattended, use the Company’s password and multi-factor authentication requirements, and install updates promptly; (d) not use public or shared wireless networks for Company work without the VPN; (e) keep printed Company documents secure and shred them when no longer needed; (f) position screens so that household members and visitors cannot view Company or customer information, and not allow anyone else to use Company Equipment; (g) hold confidential and personal information in strict confidence in accordance with the Employee’s confidentiality obligations and applicable privacy law; and (h) report any suspected security incident, loss or unauthorized access within twenty-four (24) hours. The Company may monitor Company Equipment and accounts as permitted by law and its policies, and the Employee should have no expectation of privacy in them.

7. Workspace Safety and Workers’ Compensation

The Employee shall maintain a safe, ergonomic workspace at the Remote Location free of hazards, and confirms that the workspace is adequately lit, ventilated and wired, with a working smoke detector. The Company will provide ergonomic guidance on request. Injuries sustained by the Employee in the course of performing work during working hours at the Remote Location are covered by workers’ compensation to the extent the law provides, and the Employee shall report any work-related injury to the Company immediately. The Company is not responsible for injury to any other person at the Remote Location or for damage to the Employee’s property. On reasonable notice and at a mutually agreed time, the Company may inspect the workspace, in person or by video, to confirm compliance with this Agreement and to retrieve Company property. The Employee is responsible for confirming that remote work does not breach any lease, homeowners’ association rule or insurance policy, and for any tax consequences of the arrangement, on which the Company gives no advice.

8. Ending or Changing the Arrangement

Either Party may end or modify this arrangement on [Notice to end or change the arrangement (days)] days’ written notice to the other, and the Company may end it immediately if the Employee breaches this Agreement, if performance or business needs require, or if the Employee’s position changes. When the arrangement ends, the Employee shall report to the Company office designated by the Company on the date the notice states, and shall return the Company Equipment. Ending the arrangement is not a termination of employment and does not by itself change any term of employment; failure to report to the office when required will be treated as any other failure to report to work. Nothing in this Agreement changes the at-will nature of the Employee’s employment.

9. General

This Agreement is governed by the laws of the State of [Governing law (state)], except that the wage and hour, expense reimbursement and workplace safety laws of the state where the Employee actually works apply to the extent they are mandatory. It is the entire agreement between the Parties about remote work and supersedes any prior remote work approval; it may be amended only in a writing signed by both Parties, and any change to the Remote Location, schedule or equipment shall be recorded in an amendment. If any provision is held unenforceable, the remainder continues. This Agreement may be signed electronically and in counterparts, and the electronic execution record, timestamps and document fingerprints kept by the signing platform are conclusive evidence of its execution.

Remote Work Agreement FAQ

Does a remote work agreement change the employee’s status or pay?

No. The agreement says expressly that remote work changes nothing about the employee’s pay, benefits, classification, duties or at-will status. It is an arrangement about where and how the work is done, not a new employment contract. If pay is being adjusted for a change in location, put that in a separate letter so the two are not confused.

Can the company end the remote arrangement?

Yes. The agreement lets the company end or modify the arrangement on the number of days’ notice you fill in, and immediately if the employee breaches it or business needs require. The employee may also end it and return to the office on the same notice. Refusal to return when the company ends the arrangement is treated like any other refusal to report to work.

Who pays for internet, phone and a desk?

You choose. The agreement lets you list the equipment the company provides and either a monthly stipend or reimbursement of specific expenses. Several states, including California, Illinois, New York and others, require employers to reimburse necessary business expenses, which for a remote employee includes a reasonable share of internet and phone; a stipend that covers those is the simplest way to comply.

What if the employee wants to move to another state?

The agreement requires written approval before the employee changes their remote location, and specifically before moving to another state or country. That is because the employee’s work location determines which state’s wage, tax, leave and workers’ compensation laws apply and where the company has to register for payroll. Approve the move only after payroll and HR have confirmed the company can comply.

Can I leave the schedule or equipment fields blank for the employee to fill in?

Yes. Any blank you leave becomes a field the employee completes when they open the link, and you see what they entered before you countersign. Employers usually fill in the schedule, stipend and security rules and leave the employee’s home address, phone and description of their workspace for the employee, since they know those.

Are injuries at home covered by workers’ compensation?

Generally yes, if the injury arises out of and in the course of employment, which for a remote employee means during working hours in the designated workspace while doing work. The agreement requires the employee to keep a safe workspace, to report injuries promptly, and to allow a reasonable inspection on notice. It does not cover injuries to family members or visitors, which are the employee’s responsibility.
